Alternative Dispute Resolution in Minnesota

Most civil cases are subject to Alternative Dispute Resolution (ADR) processes. Most notably, family law cases which involve domestic abuse or allegations of domestic abuse are not.

There are several binding (Arbitration) and non-binding forms of ADR. It is becoming common for courts to order ADR in family law cases, especially where the future of minor children is involved. Usually ADR is facilitated by an individual or group of individuals who have been qualified neutral under Rule 114 of the Minnesota General Rules of Practice.
Mediation is a form of ADR that uses a neutral third party to facilitate an agreement between the parties. Many couples attempt to negotiate their divorce (or parts of their divorce) through mediated settlements.

While attorneys may participate in some forms of ADR, usually parties who are mediating family law issues do so without the presence of their attorneys. When you agree, it can be binding.
